    • Mr. FLORIO. Mr. Speaker, in the lengthy series of hearings on insurance that my subcommittee is conducting, one of the more troubling issues we have addressed is the rising wave of insurer insolvencies discussed in a recent hearing.
      • A number of concerns have been raised regarding the current system of State solvency regulation.
      • Some observers have suggested that problems include inadequate data and industry reporting to State regulators, conflicts among the States, and inadequate State guaranty funds for payment of the claims of insolvent insurers.
      • Articles apprearing in the National Underwriter and the Journal of Commerce described our hearing, including proposals for Federal action.

      • (p167) - Life Insurance. There is a high level of consumer ignorance regarding various types of life insurance coverage. The most common shortcoming in this area involves the payment of premiums over an extended period of time which far exceeds the face value of the policy and benefits thereunder. Promotion of life insurance among the elderly may emphasize the desire to provide for one's survivors. Salespersons may play upon the elderly person's parental feelings while ignoring the fact that the individual's children are full grown, employed and financially secure. Life insurance needs of the elderly, particularly the widowed, may be minimal or nonexistent. The widowed person does not have a
        spouse to provide for. For a couple, except when the death of the spouse results in loss of pension benefits, the death of one's spouse may not result in income 10ss.89

    • By entering into modified coinsurance agreements under Section iv, 820 of the Internal Revenue Code, some insurance companies--most notably the very large mutual companies --are able to convert investment income on which they pay taxes into underwriting gains on which they pay little, if any, taxes. This was not the intent of Congress when section 820 was included in the code.
      • It was intended to avoid possible double taxation when these coinsurance arrangements are used.
    • Without a section 820 election double taxation could occur because both the original insurer and the company sharing the risk would be subject to tax on some of the same income.

        • I understand that it was a staff study that concluded that buying life insurance was not a good investment.
